BPAS Job Advert: Surely this is in breach of Equality Law

Tuesday 10.30 to 16.00

Working as part of the team at our unit in Brighton you will complete administrative and client support tasks within the unit in accordance with bpas' policies, procedures and quality standards.

The successful candidate will have at least 4 GCSE’s or the equivalent. Administrative experience with face to face client contact would be beneficial.

More importantly you will be non-judgmental, a team player and be able to maintain strict confidentiality.

All applicants must be pro-choice.

Sounds discriminatory to me. As far as I know you can't advertise for a teacher in a Catholic school and state they have to be Catholic. So....

I have read your recruitment announcement with great interest and believe I am not only more than qualified for the position but also would prove to be a great asset for your organization. I must however confess that I do not quite understand what you mean when you require that all applicants be 'pro-choice'. I should be grateful if you would specifically define that term/qualifier that I may proceed with my application. I believe the absence of definition of this qualification may prove a positive hindrance not only to the submission of my own application for the position but also many others who may be interested. is not meant to eliminate practising Muslims from the job applicant pool.

What do they mean by "non-judgmental"? Certainly seems as if this evil organisation is institutionally judgmental. In fact, it arbitrarily condemns innocent children to death, and carries it out for a fee. They need to learn how to write with greater clarity too - "pro-choice" is so vague a term as to be meaningless, and if it's a qualifying criterion of the job, it ought to be very specific. Those with a conscience need not apply.

There is a legal term concept, 'verba fortius accipiuntur contra proferentem', which essentially means ambiguities and imprecisions in the language of contracts are to be rigorously construed against those who wrote the contract.
I suspect this job announcement may be construed as a public offer, i.e. an implied contract.
I don't practice in the UK, however.

It'd be more in the way of "an offer to treat" as per goods on sale in a shop window. The general principle is still applicable though.
